                        Be it known that at the term of the
Circuit Court for St. Johns County, at St. Augustine, the 17th
June 1846
                 Present the Hon. George S. Hawkins, Judge
Joseph M. Hernandez
       vs                                           Scire facias
Benjamin A. Putnam Exec of Peter Mitchell
                         Now in this day came the parties
Joseph M. Hernandez and Benjamin A. Putnam, Executor of
the last will and testament of Peter Mitchell, deceased, and the
said defendant admits that the said Peter Mitchell died seized of
lands and tenaments within the jurisdiction of this Court of
a greater value than the residue of the recovery against the
aid peter Mitchell in the said plaintiffs declaration men-
tioned as remaining unpaid by the said Peter Mitchell at the
time of his death, and says nothing in bar or preclusion of the
Execution prayed by said plaintiff,
     Therefore it is considered by the Court, that the said plaintiff
have execution agains the said defendant as Executor as aforesaid for
the sum of five thousand seven hundred and forty six dollars and
fifty five cents, with the interest theron to computed at the rate of
six per centum per annum from the date hereof untill paid, together
with the sum of four dollars and fifty six for his costs in this
behalf expended to be levied of the lands and tenements of which
the said Peter Mitchell died seized as aforesaid and of any goods
and chattles which were of the estate of the said Peter Mitchell
at the time of his death, and which may hereafter come to
the hands of the said Benjamin A. Putnam, as executor as
aforesaid to be administered.
           I, Peter B. Dumas, Clerk of said Circuit Court
            do hereby certify the above to be correct transcript from the
            records now in my office.
           In testamony whereof, I hereunto set my hand and affix the
            seal of said Circuit Court, at the City of St. Augustine on the
            sisteenth day of January in eighteen hundred and forty nine.
