named as interested therein, which they Shall exercise their best judgment
in, but shall not be liable for any less thereby under the circumstance
as stated, that is, where due diligence and their best Judgment is and
they, my hereinafter named Executors, Shall Sell and dispose of all my thus
named, bequeathed, and devised, and last named property, Estate real and
personal, goods and chattles as mentioned already for the term of two
years, and forever if it can be effected to advantage, and shall make
dividen yearly of all the sales that shall be made of parts and
portions of said property or estate till the whole shall be sold, I
do hereby nominate my two said sons John H. Brush and Charles
W. Brush, my Executors to this my last will and Testament, revoking 
all former wills made by me and lastly, my express will and meaning
is, and I do hereby order, and appoint that, if any difference, dispute,
question or controversy Shall be moved, arise or happen, concerning any
gift, bequeath, matter or thing in this my will given and bequeathed,
expressed or contained, that then no suit or suits in law or Equity or
otherwise shall be brought, commenced prosecuted for and concerning the
same, but the same shall be referred wholly to the award, order, and
determination of my friends William Woodhull of the City of New
York, and Peter P. Monfort of Dutchess County, N. York that and
what they, or the Survivor of either of them shall award, direct or determine
therein, Shall be binding and conclusive to all and every person and persons
therein contained, This tenth day of March in the year 1843.
     The above instrument containing one Sheet was here subscribed by
     Nehemiah Brush, the Testator, in the presence of each of us, and
     was at the same time declared by him to be his last will and Testa-
     ment, and we, at his request, signed our names thereto attesting witness

A Codicil to my last WILL and TESTAMENT,
WHEREAS I Nehemiah Brush of the Town of Fish Kill County
of Dutchess and State of New York Physician, being of sound
mind and memory, and having made my last WILL and TESTA-
MENT in writing bearing date the Tenth day of March in the
year of our Lord one Thousand Eight hundred and forty three, which
said WILL was executed by me in the City of New York, and having
thereby made constituted and appointed Peter P. Monfort of the Town
of Fishkill, County of Dutchess and State of New
York Farmer, and William Woodhull of the City, County and
State of New York, Merchant, advisor to my Executors therein
appointed, in case they have any difficulty in Settling my Estate,
NOW I do by this writing, which I declare to be a codicil to my
said last WILL and TESTAMENT and to be taken as a part thereof
