Seal, this third day of October in the year of our Lord one
thousand eight hundred and forty three

  Surrogate office       I, Robert Wlkinson, Surrogate 
of said County, do certify, that on the third day of October, in 
the year of our Lord one thousand eight hundred and forty three, 
before me, the said surrogate, personally appeared, Eugene Van
Ness and John H. Brush, Executors of the last will and testa-
ment and Codicil thereto of Nehemiah Brush deceased, named
and took and subscribed an oath or affirmation faithfullly and
honestly to discharge the duties of such Executors according to law, and
the said will and codicil having been duly admitted to probate,
letters testamentory thereon were then and there granted to said Executors.
        In Testamony whereof, I, the said Surrogate, have hereinto
         set my hand, and affixed my official seal, this third day
(seal)   of October, in the year of our Lord one thousand, eight
         hundred and forty three.

  Whereas, Nehemiah Brush, deceased, left a will executed 
in due form of law to pay real estate, in which John H.
Brush & Eugene van Ness and Charles W.  Brush were
appointed his executors, all of whom have been duly qual-
ified as such and said duly admitted to Probate in
Dutchess County, New York, the place at which said Testator
died and whereas said N. Bursh died seized of certain
tracts of land in Florida, and other states as well as a 
quantity of personal property which he directed his Exec-
utors to sell within a certain specified time after his
decease, and wheras also since the decease of the said
Testator, the said John H. Bursh has also deceased, and
the said Eugene Van Ness being desirous that the
interests of the said Testator may be fully and adequate-
ly represented, he not being able by reason of other im-
portant duties to devote that attention to them which
their importance demands, and being also desirous
to clothe the said Charles W. Brush his co-execution
with all the authority and power they acting jointly
would possess ~~~~~~~~~~~~~~~~~~~~~~
