Whereas on the 15th day of November 1848 a certain John McKinley
of the County of Alachua and State of Florida, by his certain
Indenture, bearing the day and year aforesaid and of record in the
office of the Clerk of said County of Alachua, bargained, Sold, and
delivered to Horrace Merry of said County and state the following
described Negroes, to wit; Emily a female aged about twenty two years
Cuffy a male aged about six years son of Emily, George a male
aged about three years also son of Emily, and Tenna a female aged
about twenty one years, to have and to hold said Slaves to the said
Horace Merry his heirs and assigns forever, with condition annexed
in and by said Indenture; that if the Said John McKinley shall well
and truly pay to the said Horrace Merry the Sum of fifteen hundred dollars
the amount of a promissory note, bearing like date with said indenture
executed by said John McKinley to said Horrace Merry for said
amount, and payable as set forth in said promissory note and executed
in said indenture, then the said indenture to be veri and obligative
without effect, otherwise to continue in full force, and the title
to said Slaves to vest and remain absolutely in Said Horrace
Merry, all of which will more fully appear by reference to said
deed and promissory note, of record as aforesaid in Clerks Office of
said County of Alachua, to which is here made, and the same is
to be taken and regarded as a part of this indenture, and when
the said John McKinley and Horrace Merry have annulled and
cancelled the conditions by reason of which the said Sum of fifteen
hundred dollars become due and payable from the former to the
latter, and the said Horrace Merry hath Surrendered and delivered
up to the said John McKinley said promissory note for fifteen
hundred dollars, and release to the Said John McKinley all claims
on account thereof, now this indenture witnesseth, that the said |
