KNOW ALL men by these presents that I Bennett M. Dell
of Alachua County Florida in consideration of the sum of One
Hundred dollars to him in hand paid by James Pendarvis of said
County the receipt whereof he doth hereby acknowledge do hereby
convey remise release and forever quit claim unto the said James
Pendarvis his heirs and assigns all that tract or parcel of land
situate in said County and designated in the Official Plat
of the Survey of the said land by the United States of America
as the West half of the North West quarter of Section Number
two (2) in Township Number eight (8) South of Range number
Eighteen (18) East with all the privileges and appurtenances
thereto belonging; To have and to hold the above released premises
to the said James Pendarvis his heirs and assigns to his and their
use and behoof forever~
And I the said Bennett M. Dell for myself and my heirs
Executors and Administrators do covenant with the said
James Pendarvis his heirs and assigns that the premises are free
from all encumbrances made or suffered by me, and that I
will and that my heirs Executors and Administrators shall warrant
and defend the same to the said James Pendarive his heirs
and assigns forever against the lawful claim and demand
of all persons claiming by through or under me but against
none other, And I the said Bennett M. dell do hereby
assign and set over unto the said James Pendarvis his heirs
Executors and Administrators any claim or demand which
I now or may hereafter have on said United States to refund
the money paid for the said land or any part thereof to
said United States together with all interest due and which may
hereafter become due theron in case of a failure of title or from
any other cause whatsoever.
And I Eliza Dell wife of the said Bennett M. Dell making
myself a party to this Deed in consideration of the sum of One
Dollar to me paid the receipt whereof I do hereby acknowledge
do hereby release and relinquish unto the said James Pendarvis
his heirs and assigns all my right and title of Dower in the
land and premises herein before described and released~
In testimony whereof we have hereunto set our hands and affixed
our seals this 11th day of April A.D. 1846.
