This Indenture of three parts made this twenty fourth day
of September in the year One thousand eight hundred & forty five
between Charlotte L. Pyles of Alachua County, gentlewoman of the
first part, Samuel R. Pyles Esquire of said County of the second
part, and George Helvinston gentleman of the third part,
Witnesseth; That Whereas a marriage is intended to be had
and Solemnized between the said parties of the first and third
parts, and the said party of the first part is possessed of certain
personal Estate "to wit, four Negro slaves-viz- Maria, Primus
Lill & Randall, which said Slaves, the said party of the first
part with the Consent of the said party of the third part, is
minded and disposed to transfer to the said party of the second
part in trust for her own proper use and benefit
Now therefore in Consideration of the premises and of one dollar
paid by the said party of the Second part to the said party
of the first part (the receipt whereof is hereby acknowledged)
the said party of the first part doth bargain, sell, assign
and transfer to the said party of the second part the said
named Negro slaves with all their and each of their further
issue and increase to hold the same to him the said party of
the second part and his Executors & Administrators upon the
special trusts and for the uses and purposes following, namely;
In the first place that until the solemnization of the said marriage
the said party of the second part shall pay on to the said
party of the first part or shall empower her to receive for her
own use all the income & profits owing from the services of said
Negro slaves and from any other Estate which my be substituted
therefore as is herein after provided.
Secondly, That from and after the Solemnization of the said marriage
and during the coventure of the said party of the first part the
said party of the second part shall permit and allow the said
party of the first part to hold and enjoy the said negro slaves
and their increase and the issues & profits arising from the services of
said slaves and to have such use & control of said slaves as she
the said party of the first part may desire, and that the parties
of the second and third parts shall not interfere with such
use and Control of said slaves, and that the said slaves and
their increase or any part thereof shall not be liable for the
debts or other liabilities of said party of the third part or at
his disposal.
Thirdly, That in case of the death of the said party of the
first part after the solemnization of said marriage and during
