Know all men by these presents; that whereas Thomas
C. Ellis and his wife Sarah Ellis of Alachua County
Florida by a certain Indenture under their hands and seals
bearing date the third day of September AD 1841 did grant
bargain and sell unto William W. Tucker then of said
County now of Benton County Florida for and in considera-
tion of the sum of three & Sixty five dollars paid to the said
Thomas C. Ellis by the said William W. Tucker a certain or parcel
of land lying and being in said County of Alachua and described
in said Indenture as the North half of the West half of the South
East Quarter of Section Numbered ten(10) also about ten acres
bounded by parallel lines off the west side of the south East Quarter
of the South East Quarter of said Section numbered ten (10)
including the improvement thereon be same more or less Said Section
(11) being in Township Eight (8) Range Eighteen (18) of the United
States Survey~~~~And it having been described since the Execution
of the said Indenture by the parties to the same that the said
Ellis and his wife had no right or authority to grant, bargain
sell or in any way transfer the said tract or parcel of land
and that he could not make any good and sufficient
title thereto and the said Ellis having preffered to make
compensation & Satisfaction to the said Tucker for any loss
occasioned by his (said Ellis) failure or inability to make
and execute good and sufficient titles provided the said Tucker
would execute under his hand and seal a release of all claims
or demands which he said Tucker might have on said Ellis
for and on account of such failure & inability to make good
and sufficient titles as aforesaid and provided the said Tucker
would release and quit claim the said tract or parcel of land
unto him the said Ellis under his (said Tucker) hand and seal
And therefore in consideration of the premises and of one
hundred and twenty five dollars to me paid by the said Ellis
the receipt whereof is hereby acknowledged, I the said William
W. Tucker do hereby remise, release, and forever quit claim unto
Thomas C. Ellis and his heirs all the Estate right, title interest and
trust claim and demand whatsoever both at law and in
Equity which I the said William W. Tucker have of in
to or out of the tracts or parcels of land above described, so
that neither I the said Tucker my heirs or assigns or any
other person or persons in trust for me or them or in my
or their name or names or in the name right or stead of
and of them shall or will can or may by any
