thereof. And also all the Estate, right, title, interest, claim in her own
right or as Executrix property, possession, claim and demand whatsover
as well in law as in Equity, of the said party of the first part, of, in, or
to the above discribed premises, and every part and parcel thereof, with the
appurtenances: To Have and to Hold, the above grantee and discribed
premises,with the appurtenances, unto the said parties of the second part, their
heirs and assigns, to their own proper use and behoof forever,
and the said Ellen A. Beatty and her Executors and her heirs, the said premises
in the quiet and peaceable possession of the said parties of the second part, and their
heirs and assigns, against the said party of the first part and her heirs,
and against all and every person and persons whom soever, lawfully claiming or
to claim the same, Shall and will Warrant and by thes presents forever
Defend, such claim coming from by or through said Joseph M. White or
his heirs, or assigns, or the said Ellen A. Beatty her heirs assigns;
And the said Ellen doth hereby convenant with all and each of said parties
of the second part jointly and severally and their heirs and assigns jointly
and severally, that at the time of making this conveyance she is sole
and lawful sole and lawful owner of the premises above grantee without
notice of any adverse claim, and seized of a good and indefeazable
Estate of inheritance thereon as amply and fully as said White, or said Beatty,
or either of them jointly with her, or sher herself has ever held, that said
premises, title and claim are free and clear of all incumbrance transfer
alienation or other disposition by said Joseph, or said Theophilus, or said Ellen,
and also free of all tax sales or arears of taxes, or other duties or liabilities
to the State or any county thereof; that she is sole devisee of said premises by
both the wills of said Joseph M. White and said Theophilies Beatty and that said
wills are duly recorded, duly executed, and duly admited to probate in Jefferson
County Florida, the late residence of said Joseph and Theophilus respectively;
that she is the sole and lawfully qualified and appointed under and by each of
said wills respectively, and that she has full and absolute power to dispose
of said premises by said wills.
      In witness thereof the said party of the first part hath
hereunto set her hand and affixed her seal the day and year first above
