bargain, sell, alien, remise, release, convey and confirm, unto the said
parties of the second part, and to their heirs and assigns forever, all and
singular the following discribed*** lot or parcel of lands or premises, to wit,
sixteen hundred and sixty six acres of land (1666) derived by deed from
Moses E. Levy to White bearing date June 30th 1835, and discribed in
said deed as follows, that tract or parcel of land lying and being in the
County of Alachua in Florida, and designated on the plat hereto annexed
by the number six (5) and the name J.M. White, containing sixteen
hundred and sixty six acres, being part of tract of twenty thousand acres
(20000) confirmed unto the said Moses Elias Levy by decree of the Supreme
Court of the United States as part of a grant for twenty two thousand
acres (22000) originally granted to George S.F. Clark on the seventeenth
day of December Eighteen hundred and seventeen (17th Decr 1817) in
the hammocks of Cuscowillo and Chacula, west of the River St.
Johns, and which said twenty thousand acres was so confirmed to the
said Levy according to the said survey the second of August Eighteen hundred
and nineteen, to said parties of the second part as tenants in common and
not as joint tenants, that is to say one half to said Brockenbrough, and
one fourth each to said Sims and Cheever. Together with all and singular
tenements, hereditaments and appurtenances thereunto belonging or in
any wise appurtaining and the reversion and reversions, remainder and
remainders, rents, issues, and profits thereof, And also, all the Estate,
right, title, interest, (in her own right or as Executrix), property, possession,
Claim, and demand whatsoever, as well in law as in Equity, of the said
party of the first part, of, in, or to the above discribed premises, and every
part and parcel thereof, with the appurtenances:
To Have and to Hold, the agove granted and discribed premises,
with the appurtenances, unto the said parties of the second part, their
heirs and assigns, to their own property use and behalf forever.
And the said Ellen A. Beatty, her Executors and her heirs, the said premises,
in the quiet and peaceable possession of the said parties of the second
part their heirs and assigns, against the said party of the said party
of the first part, her heirs, and against all and every person and persons
whomsoever, lawfully claiming or to claim the same, shall and will Warrant
and by these presents forever Defend, such cl claim coming from by
or through Joseph M. White his heirs or assigns, or said Theophilus Beatty
his heirs or assigns, or said Ellen A. Beatty her heirs or assigns, and the said
Ellen doth hereby covenant with all and each of said parties of the second
part, their heirs and assigns, that at the time of making this conveyance,
she is the sole and lawful owner of the premises above granted without
notice of any adverse claim, and seized of a good and indefeazable
Estate of inheritance therein forever or fully & perfectly as the same was
at any time in said White in his life time, that said lands and
