                  This Indenture made this the fifth of
February one thousand eight hundred and twenty four between
John A. Kennedy of the Town of Camden in the District of
Kershaw and State aforesaid of the one part, and Thomas
Starke of the District and State aforesaid Trustee of Charlotte
Rochells of the other part; Witnesseth that whereas a
marriage is shortly to be had and solemnized between the
said John A. Kennedy and Charlotte Rochell of Fairfield
District; And whereas the said Charlotte Rochells is seized
and possessed of the following negroes and other property
hereafter mentioned and specified that is to say, Gabriel,
a Negro man, Pratilda, Nelly, Serena, and Stephen, the two
last being children of the sd Nelly, which said property
the said John A. Kennedy is anxious to settle on the said
Charlotte Rochell his said intended wife and the heirs of
her body forever is the said marriage should be and made
solemnized as aforesaid. It is therefore covenanted and
agreed by these presents between the said John A. Kennedy
and the said Thomas Starke Trustee of the said Charlotte
Rochell in manner following that is to say, that said John
A. Kennedy for himself, his heirs, Executors, and Administrators
have & do hereby covenant & agree with the said Thomas
Starke as the Trustee of the said Charlotte Rochell that
in case the said marriage should be had and solemnized
as aforesaid that he the said John A. Kennedy will by
good & sufficient conveyance or conveyances in law settle
the whole of the property above mentioned upon the said
Charlotte Rochell in manner following, that is to say, first
upon himself and the said Charlotte Rochell during the
time of their natural lives and if the said John A. Kennedy
should die first, then upon the said Charlotte during her
natural life and after her death upon heirs of her body
lawfully begotten and if she should die without issue,
as aforesaid then upon the next of Kin and heirs at law
of the said Charlotte Rochell & I do hereby bind myself my
heirs, Executors and administrators in case the said marriage
should be had & solemnized to make and execute this said
marrige settlement and settle the whole of the property
above mentioned upon the said Charlotte Rochell in manner
and form above mentioned and it is the express agreement
