Alachua County ) This Indenture made on the ninth day
of December in the year of our Lord One thousand eight hundred
and fifty four between John S. Livingston of the County of
Putnam and State aforesaid of the first part, and Elias
Bauknight of the County and State aforesaid of the second
part, Witnesseth, That for and in consideration of the sum
of Seven hundred and fifty dollars to me in hand paid at
and before the sealing and delivery hereof the receipt
whereof is hereby acknowledged, the said party of the first
part hath bargained sold, given granted and conveyed, and
by these presents doth so bargain sell, give grant and convey
unto the said party of the second part, all that certain
hereditament parcel or lot of land lying and being situate
in the village of Micanopy State and County aforesaid, and
known and described as follows, that is to say, Beginning at
the North west corner of Mess Hunter & Stokes Blacksmith Shop
thence south along the eastern enclouser of said lot one
hundred and fifty feet to a pine stake, thence west one hundred
and Eighty five feet to the open square, thence south along the
western enclouser of said lot one hundred and fifty feet, thence
East one hundred and eighty five fee to the place of begining
and containing three fifths of an acre, more or less, being
part of section twenty six, township Eleven, south of Range
twenty, East of Arredondo Grant, to have and to hold
the aforesai granted premises with all and singular the apper-
tenances thereuno belonging, and all the estate title and
interest, of the party of the first part, therein or to the same in
any wise belonging, unto the said party of the second part, his
heirs and assigns in fee simple forever and the said parties
of the first part doth hereby covenant and agree with the said
party of the second part, that at the sealing and delivery of
these presents the said party of the first part is the lawful owners
in fee simple, absolute, and that he will, and his heirs executors
and adminisrators shall warrant and defend the afore granted
premises in the quiet and peaceable possession of the said party
of the second part, his heirs and assigns forever
And in accordance with a decree of Circuit Court, this conveyance
is expressly made by the party of the first and acepted by the
party of the second part, with the following conditions attaching there
to in perpeturity forever that is to say that no whiskey shop or
or other place for retailing ardent spirits shall ever be kept on
said premises or any part thereof, and in case of a violation of
this condition, the premises upon which the same is held, and the
conveyence of any portion of the premises, which shall be so used, shall
be null, and shall be forfeited to the last vendors.
In witness whereof the party of the first part hath hereunto set his
hand and afixed his seal this day and year first above written
