Alachua County } This Indenture made on the fourteenth day of
April A.D. one thousand eight hundred and fifty five, between
John D. Hennis of the first part, and George B. Payne for the use
Mess Eubank & Gault of the second part, Witnesseth, that
whereas the said party of the first part, owes John M. Payne
& Co or bearer a note bearing his signature, and dated Jan 1st
1855 due one day after date for fifty six dollars and seventy
two cents, and also a note signed by him the said party of the first
part in favor of R.P. Haler & Co for two hundred and eighty dollars
& 81 cts, dated Jan 1st 1855 due one day after date as well as a
note signed by the said party of the first part, in favor of Merry
Child & Co or bearer, for two hundred and thirty five dollars, and fifty
three cents, dated Jan 1st 1855, and due one day after date, and
whereas the said George B. Payne is the bearer of the foregoing notes
and whereas also he has placed said notes in the hands of G.M.
Means for collection, and the amt when collected to be paid over
to the said Eubank & Gault to satisfy claims in the hands of said
Means for collection in favor of said Eubank & Gault against
the said George B. Payne; And whereas the said several notes of
hand are now due and owing & whereas it is the desire of the
said party of the first part to secure the payment of the same
& for the further consideration of being indulged in the payment
of said notes until the first day of January A.D. one thousand
eight hundred and fifty six, the said party of the first part
has given, granted, sold & conveyed, & by these presents, do so give
grant, bargain, sell and convey unto the said party of the second
part his heirs and assigns, all that certain plantation or parcel
of land known and described as follows, to wit, Fractional Section nine
of Township eleven and Range twenty one in the Arredondo Grant containing
four hundred and fourteen acres more or less. To have and to hold
the aforegranted and described parcel of land unto the said party of the
second part, his heirs and assigns forever, with all the improvements therein
provided always notwithstanding that if the said party of the
first part, shall well and truly pay or cause to be paid the said several
notes at hand, together with the amount of interest due thereon on the first

shall be null & void, and of non effect, otherwise to be and remain
in full force and virtue.

hereunto set his hand and affixed his seal; on the day and year
