of land situated in the Village of Micanopy and known
and described as follows, to wit: the inclosure formerly
occupied by John H. Zawadski and now occupied by
Wm D. Eubank and bounded on the North by the
street which passes along the southern side of the
public square in the said Village of Micanopy, on
the west by land now owned by William Edwards and on
the south and east by lands now owned by the said Christopher
L. Fribelie (meaning the land or a part thereof conveyed to the party
of the second part by these presents, said land in said
exception containing six acres more or less, as well also is 
excepted from the aforesaid land and premises herein and
above deeded by the said parties of the first part, unto
the said party of the second part, the certain town lot
or parcel of land on which the store house now occupied
by R.B. Duke stands, comprising all the land owned
by the said Christopher L. Fribly in the Village of
Micanopy, the land in said exception at the date of these
presents and before the above bargain and sale he had
Deeded and conveyed to others, and the time " now own
owned in the above exception and reservation must be
understood as on the fifth day of January A.D. 1854,
To have and to hold the said described land herein and
above granted, excepting that which is herein and above
mentioned unto the said party of the second part, his
heirs and assigns to the only proper use and behoof of
the said party of the second part, his heirs and assigns
forever, and this conveyance is expressly made subject by
the said parties of the first part, and is accepted by the
said party of the second part, to the following condition
which is to follow the above granted premises, and every
part and parcel thereof in perpetuity forever, and all future
conveyances hereafter to be made shall be made subject
to the following conditions, that is to say, that no whiskey
Shop, or other place for retailing spirituous liquors or
                                shall
ardent spirits shall now, or ever^be kept on the said
premises, or any part of the same, and in case of a violation
of this condition, the said party of the second part, his heirs
and assigns, shall forfeit all the grant in this or any
deed hereafter made, by them by these presents, and the
said parties of the first part, for themselves their
heirs Executors and administrators, do covenant and
agree with the said party of the second part, his heirs
and assigns, that they are seized in fee of the afore_
foregranted premises and that they are free from all
incumbrances, that they have good right to sell and
convey the same to the said party of the second part
that they will and their heirs and assigns shall
warrant and defend the same unto *** the said party
of the second part, against the lawful claim or
demands of all persons whomsoever
