his heirs executors and administrators shall warrant
and defend the above granted premises in the quiet
and peaceable possession of the said party of the second
part her heirs and assigns forever.
And in accordance with a decree of Circuit Court
this conveyance is expressly made by the said party
of the first part and accepted by the party of the
second part with the following conditions attach-
ing thereto in perpetuity forever. That is to say
That no Whiskey Shop or other place for retailing
ardent spirits shall ever be kept on said prem-
-ises or any part or parcel thereof and in case of
the violation of this condition the premises upon
which the same are held and the conveyance of
any portion of the premises which shall be so used
shall be null and shall be forfeited to the
last vendor.
In Testimony whereof the said party of the first
part hath hereunto set his hand and affixed his
seal this day and year first above written

the undersigned a Justice of the Peace in and
for the County aforesaid Joel B. Smith who ack-
-nowledged that he executed the foregoing Indenture
for the purposes therein set forth. In testimony
whereof I have hereunto set my hand this twenty
second day of February AD 1856

Know all men by these presents that I Patience
E. Smith wife of the within named Joel B. Smith
do hereby relinquish my right of Dower in the
lot or parcel of land conveyed by the foregoing
Indenture to Elizabeth Agnes Garrison.

A.D. 1856.

do hereby acknowledge that the above relinquish-
ment of Dower was made on my part freely
voluntarily and without any fear apprehension
or compulsion of or from my husband Joel B. Smith,
