demise of the said Giles U. Ellis and subsequent marriage
of said Nancy L. Townsend the said Negress together with
her increase and the Negro Ben to revert to the heirs of
the said Giles U. Ellis.~~~~~~
And Whereas furthermore it is agreed between the parties
that in the event of the said Nancy Townsend surviving
her intended husband the said Giles U. Ellis she the
said Nancy Townsend as the widow of the said Giles
U. Ellis shall be entitled to Keep and retain possession
of the dwelling house in which the parties to these
presents may happen to reside at the time of the demise
of the said Giles U. Ellis together with the plantation there
to attached or so much thereof as she may desire or
require so long as she shall remain to the dire and faith-
ful performance of which agreement to and
with the said Nancy L. Townsend the said Giles U. Ellis
his heirs executors or administrators do by these presents
convenant and agree.~~~~~~~~~~
And Whereas it is yet further agreed by the said parties
that in case it should so happen that there should
be issue of the said intended marriage or their
children who altogether shall represent their parent
living at the demise of the said Giles U. Ellis that such
issue shall possess and inherit share and share
alike with the children or their representatives of
the said Giles U. Ellis of his former marriage, less
however their amount or proportion which said
issue may inherit from his her or their mother
the said Nancy Townsend out of such property as 
she now possesses in her own right or may hereafter
possess by gift purchase inheritance or otherwise upon
a division of such estate and distribution thereof~ the
said Nancy Townsend agreeing and declaring that in
the event of issue of the said intended marriage an
equal portion of any property she may possess shall with
her other children be awarded to him her or them; and
the said Nancy Townsend convenants and agrees to
and with the said Giles U. Ellis his heirs executors
or administrators that she will make no disposition
conveyance or transfer of any such property whereby
the issue of said marriage might be prejudiced and
all this in order and with the interest and property
that the children of the said Giles U. Ellis of his first
as well as of this his intended marriage may possess
equal and proportional inheritance~~~~~~~~
Now this Indenture Witnesseth that for and in
consideration of the above recited relinquishment
gift contract agreement premises and provisions
securing unto the said Nancy L. Townsend a com-
petent maintenance secured from the debts or
claims of her intended husband and of property
which she now possesses as dower from the Estate of
her late husband and otherwise so long as she
