of Florida by an act approved Jany 6th AD Eighteen
hundred and fifty five to aid in the construction of their
lands
said Road, Also all other tracts now owned by the said
Florida Rail Road Company or which may hereafter granted
to them along the line of their said road, either by the State
of Florida or by the Government of the United States
of America
To Have and to hold the above described prem-
ises, and all and singular of them and every part thereof
to the said parties of the second part, their heirs
successors and assigns, as their absolute property
in fee simple forever, free and discharged from
all encumbrances of any and every nature and des-
cription, except as to the said Road way and its depots
stations, equipment and appurtenances, and that
subject to the prior lien created by the Act of the Gen-
eral assembly of the State of Florida in favour of the
Internal Improvement Fund of said State
In trust nevertheless, and these presents are upon the
following express conditions, that the said Roadway its
depots, stations, equipment, franchises and appurte-
nances shall be allowed to remain in the undisturbed pos-
sion of the party of the first part its agents and officers
until such time as default be made by the said party
of the first part in the payment of the principal
and interest of any of the bonds herein before recited
but if such default shall at any time be made,
then and so soon as it shall at any time occur that
a sum equal to one years interest on the whole of
the bonds at that time outstanding shall remain due
in arrear and unpaid, then in trust that the said par-
ties of the second part shall immediately and without any
judicial process whatsoever, enter upon and take into
possession the said Roadway with all its depots, sta-
tions, equipment appurtenances and franchises, and
either sell lease or otherwise dispose of the same in
such manner as shall in their opinion most conduce
to the ultimate benefit, advantage and security of
the bondholders, And the said party of the first
part hereby covenants and agrees peaceably and quietly
to surrender the possession of all the above described
property, and that the said parties of the second
part shall without let hindrance or molestation
be permitted to enter upon and enjoy the whole of
the above mentioned property, and to receive the
rents and profits thereof, and dispose of the same
in such manner as the said parties of the second part
may in their discretion determine
And as to all the other property herein con-
veyed, including as well the said town lots embraced
within the plans of the towns of Fernandina and Cedar
Key as well as all lands lying along the line of the
said Road in trust, that the said parties of the sec- |
