Camden County } This Indenture made this twenty fifth
day of January in the year of our Lord one thousand eight
hundred and forty nine, Between Henrietta M. Williams of the
County and State aforesaid, Spinster of the first part, Samuel
K.W. Furman of the County and State aforesaid, of the Second
part, and George W. Hardee of the County and State aforesaid
of the third part, whereas a Marriage is intended to be had
and Solemnised between the said Henrietta M. Williams, and the Said
Samuel K.W. Furman, and whereas the Said Henrietta M. Williams
the party of the first part, is now possessed of and entitled to
an undivided half of the following Negro Slaves, to wit:
Will, Mary, Linda, Tom, Phillis, Bason, Daphne, Bachus,
Patience, Stephen, Mona, Dye, Ellen, Sophy, Ulah, Sam,
Nina, Lindy, Peter, Tenah, Sarah, George, January, Will,
and Grace (R5) and also possed of and entitled to three Negro
Slaves in addition, viz. Suckey, Emma, and Abey, and also
thirty five head Stock cattle, more or less, thirty head Sheep,
more or less, one yoke of oxen, three horses, household furniture
notes and mortgages, and whereas, the Said Henrietta M. is
desirous of Settling and disposing of all her property
real or personal; upon certain uses and trusts hereinafter
and expressed, Now this Indenture, Witnesseth, that the
Said Henrietta M. Williams, by and with the consent of
her said intended Husband, Signified by his becoming a party to,
and Signing and Sealing this Indenture, and for and in
consideration of the Said intended Marriage, and also of
the Sum of five dollars, to her in hand well and truly paid
to the Said party of the third part, the receipt whereof, She
doth hereby acknowledge, hath granted, bargained, Sold,
aliened, remised, released, confirmed, and delivered, and by these
presents doth hereby grant, bargain, Sell, alien, remise,
release and confirm, and deliver unto the Said George W. Hardee
and to the Survivor of him, and, to the Executors, administrators
of Such Survivor, all the right, title, interest, claim and
demand whatsoever of the Said Henrietta M. Williams of in,
and to the aforesaid Negro Slaves, together with the Stock,
household furniture, notes and mortgages aforesaid, To
have and to hold the Same, together any other real and personal
estate to which the said Henrietta M. Williams may now,
or at any future time be possessed of, or in any manner entitled to,
with the future issue and increase of the female Slaves, Stock
&c unto the said George W. Hardee, and to the Survivor of
him, and to the executors and Administrators of Such
Survivor, In trust nevertheless, that he the Said party
of the third part, will hold the same to, and for the Sole
and Separate use, benefit and behoof of the said Henrietta
M. and her heirs and assigns, until the Solemnization of the
said intended Marriage, and from and after the Solemnization
thereof to and for the Joint use, benefit and behoof
of the Said Henrietta M. and Samuel R.W. Furman, and
the Survivor of them, not Subject however to the Separate
debts, contracts or engagements or the Said Samuel K.W. |
