acknowledged and of the further sum of one thousand dollars to be paid
as hereinafter mentioned does hereby for himself his heirs executors and
administrators and every of them covenant promise and agree to and with the
party of the second part his heirs executors and administrators and
every of them, that he the party of the first part his heirs and assigns
and all and every person or persons claiming or to claim any right title or
interest under him in or to the lands and premises hereinafter mentioned shall
and will at the proper cost and charges of the party of the second part his heirs
and assigns after and upon condition of the prompt and full performance by
the party of the second part of all his agreements herein contained by such Convey=
ances assurances ways and means in the law as the party of the second part
his heirs and assigns shall reasonably require well and sufficient by grant Sell
release convey and assure to the party of the second part and his heirs or to whom
he or they shall appoint or direct all the following described land, Situate in the
County of Alachua in the State of Florida and known and described as follows, to wit:
All of lots number fifteen (15) and nineteen (19) according to the Plat of
Mackey and Hudson as recorded in the Register of Deeds office in said
County of Alachua State of Florida with Covenants to be therein contained
that the said premises at the time of such conveyances are free from all
incumbrances and demands whatsoever except the taxes agreed herein to be
paid by the party of the second part, and with all other usual and reasonable Covenants
including covenants of Seizin and warranty.
Second - The party of the Second part in consideration of the foregoing for
himself his heirs executors administrators and assigns hereby covenants
promises and agrees to and with the party of the first part his heirs executors
and administrators that he the said party of the second part his heirs executors
administrators or some of them shall and will well and truly pay or cause
to be paid to the party of the first part his heirs executors or adminis=
trators the sum of one thousand dollars at the time and in the manner
following to wit: two hundred dollars on the first day of July AD 1882
four hundred dollars on the first day of July AD 1883 four hundred
dollars on the first day of July AD 1884 with interest at the rate of
Eight (8) per cent per annum payable annually on the first day of
July on each Year on and after July first AD 1883. Also that he or they
or some of them will pay all taxes and assessments General or
Special which may hereafter be assessed on the above described premises
previous to the day appointed by or according to law for the sale of such
land for taxes in each year Also that he or they will not commit or
suffer any other person to commit any waste or damage to or upon said
premises and that they will keep the buildings fences and improvements
on said premises in as good repair and condition as they now are
ordinary wear and decay and damage by fire or the elements excepted.
Third - It is mutually agreed by and between the parties hereto that the
times of payment above mentioned are and shall be deemed as of the
very essence of this contract and in case the party of the second part
his heirs executors administrators or assigns shall fail to make any of
such payments at the time agreed on or within thirty days thereafter
he and they shall be deemed to have abandoned and given up to the
