that he shall consistently with this agreement have charge and
control of the same except that the said Shuford is to pay all taxes
to be assessed against said lands And the said John M. Taylor
hereby upon his part agrees and binds himself and his heirs
&c that at the expiration of the seven (7) years aforesaid from the
planting out and rooting of the orange trees as aforesaid in the
event the said Shuford shall have during that time faithfully
complied with his portions of this agreement by him to be
performed the said Taylor will convey to the said Shuford by
good and Deed of conveyance one half of that portion of said
land above described that will at the end of that time have
been converted by the said Shuford into a Sweet orange grove
and also one half according to quantity and quality of the residue
of said Lots of land not planted out in Oranges unless however said
lands shall be sold in the interim as is hereinafter provided for
It is hereby further understood and agreed by and between the
said parties that the said John M. Taylor shall at all times
have the right and privilege not withstanding this agreement
but by and with the consent of said Shuford to sell dispose of and
convey the said Lots of land and all improvements and appurten =
ces thereon at such price as may be agreed on by the parties
hereto provided that if said lots of lands shall within Four
(4) years from the date hereof be sold by the said Taylor for
the sum of Three Thousand ($3000.00) Dollars or upwards of that
amount then the money arising from such sale to the extent
of Three Thousand ($3000.00) Dollars is to be equally divided between
said Taylor and and said Shuford but if within the said
Four (4) years, the said Lots of land should be sold by the
said Taylor for a sum of money less than Three Thousand
($3000.00) Dollars then in that event the said J.M. Taylor shall first
deduct and have for himself out of the proceeds of such sale
the sum of Five Hundred ($500.00) Dollars and the residue of such
proceeds after such deduction is to be equally divided between
the said Taylor and Shuford. And in the event of a sale of
said land the money paid to the said Shuford out of the
proceeds thereof is to be in full payment settlement satisfaction
discharge and release of any and all claims or rights that he
may have or by the terms of this agreement and this agreement is
then to become null and void. It is further stipulated understood
and agreed between the said parties that this agreement is entered
into by the said John M. Taylor and is predicated upon this
express stipulation that there is to be and shall be at the end
of the Seven (7) year term of years aforesaid not less than Twenty
(20) acres of said land converted into what can then be strictly
and properly termed a Sweet Orange Grove of trees of sufficient
size and growth to be properly termed a Grove.
In Witness Whereof the said parties hereto have hereunto
set their hands and affixed their seals this day and year
