negligent breach of the trust herein expressed or Con-
tained nor shall it be the duty of the said party of
the second part its Successor or Successors to effect or
cause to be affected any insurance on the property or
any of it hereby mortgaged, but it shall be the duty
of said party of the first part to Cause the buildings
erected or to be erected upon the real estate herein
Mortgaged to be insured in solvent insurance Companies
in such Sums as may be proper and reasonable
And it is expressly Covenanted and agreed by and between
the parties hereto that all and singular the Covenants
Conditions and agreements herein Contained shall
extend and apply to the Successor or Successors of the
respective parties whether they be expressly named
therein or not.
In case of a vacancy in the trusteeship under this in-
denture by death resignation or otherwise the Same
may be filled by the holders of the Said bonds upon
a notice given of a meeting to be held for that pur-
pose which notice shall be published as often
as once a week for Sixty days in a Newspaper
published in each of the Cities of New York London
and Amsterdam. The notice may be given either by
the party of the first part or by holders of bonds
secured hereby to the amount of at least Two hun-
dred and fifty Thousand dollars.
Such appointment shall not be made at said meeting un-
less a majority of the holders of the lands then out-
standing are presentt or represented by proxy and if
the said bond holders shall not have filled the said
vacancy in the manner provided in this indenture then
the said party of the first part shall appoint a Trustee.
In Witness Whereof, The Florida Transit and Peninsular
Railroad Company party of the first part has
Caused these presents to be executed on its behalf
and its Corporate seal to be hereunto affixed
and Caused the same to be attested by the signature
of its vice President and secretary, and the said
Union Trust Company of New York party of the
second part has caused its Corporate seal to be
hereto affixed and the same to be attested by its
President to signify its acceptance of the said
trust.
