T. Harper Bevill To John Cunningham

Alachua County   } Whereas I T. Harper Bevill (Bachelor)
am justly indebted to John Cunningham Surviving
partner of the late firm of Claghorn and Cunningham
in the sum of four hundred ($40000) dollars which
said sum of money is covenanted to be paid by my
two certain promissory notes bearing even dates herewith
one for the sum of Two hundred dollars payable on the
first day of August AD 1883 and another for the sum
of Two hundred dollars payable on the first day of
August AD 1884 both to bear interest at the rate of
eight per cent per annum from date. And whereas I
am desirous of fully and better Securing the payment
of said notes and the sum of money mentioned therein
Therefore know all men by these presents that I T.
Harper Bevill for and in Consideration of the premises
and of the sum of One dollar to me in hand paid
have granted bargained and sold and by these presents do
grant bargain sell and Convey unto the said John
Cunningham Survivor of the late form of Claghorn & Cun-
ningham his heirs and assigns all the following described
piece, parcel, or tract of land to wit:
The South East Quarter of Section Nineteen (19) Town-
ship Nine (9) Range Nineteen (19) S&E and Containing
157 80/100 acres more or less. Together with all and Singular
the tenements hereditaments and appurtenances thereunto
belonging. To have and to hold the Same unto the said
John Cunningham the Survivor aforesaid in fee Simple
Absolute forever. Provided however and these presents are
upon this express Condition that if the said T. Harper
Bevill his heirs or assigns shall well and truly pay
or cause to be paid the Sum of money Covenanted to be
paid by said notes together with the interest to accrue
thereon according to the legal tenor thereof then this obliga-
tion to become null and void else to remain in full
force and virtue And it is hereby further agreed and
stipulated that the said T. Harper Bevill will pay all
expenses Costs and attorneys fees which the said
John Cunningham Surviving partner of Claghorn
& Cunningham may be put in enforcing the Collection
of the aforesaid Sum of money Covenanted to be paid by
said notes by foreclosure or otherwise.
In Witness Whereof I have hereunto set my hand and
affixed my seal on this fourth day of August AD
