of the United States Represented by a note bearing even date with these
presents of four hundred dollars ($40000} payable three years after
date with interest at the rate of ten per cent per annum payable or due
annually and signed by E.A. & Mary E. Jeffords on this Indenture
Now the said parties of the first part for the better securing the payment
of the said sum of money mentioned on said note also for and in
consideration of the sum of five dollars to them in hand paid by the
said party of the second part at and before the ensealing and delivery
of these presents the receipt whereof is hereby acknowledged have granted
bargained sold delivered remised released conveyed and confirmed and
by these presents do grant bargain sell deliver remise release convey and
confirm unto the said party of the second part and to his heirs
Executors or administrators forever all that piece or parcel of land
lying & being in the Town of Gainesville in Alachua County and the State
of Florida and more particularly described as the South half of Block
Four (4) Range one (1) on the original map of the town of Gainesville
measuring one hundred & Ninety seven feet (more or less) East & West and
Ninety eight and a half feet more or less North and South & Bounded on
the West by East main Street on the South by Magnolia Street & on the
East by University Street; together with all and singular the
hereditaments and appurtenances thereunto belonging and all the
estate right title interest property & demand whatsoever as well in law as
in equity of the said parties of the first part in and to the above described
premises with the appurtenances unto the said party of the second
part his heirs and assigns to his and their own proper use benefit
and behoof forever. Provided always nevertheless and these presents
are upon this expressed condition That if the said parties of the
first part their heirs Executors or administrators shall and
do well and truly pay or cause to be paid to the said party of second
part his heirs Executors or administrators of the first part the said
sum of money mentioned in said note and the Interest accruing
thereon according to the true intent and meaning of the said
note & these presents together with all costs charges & Expenses which
the said party of the second part may incur or be put to in Collecting
the same by foreclosure then these presents shall become void and
the estate hereby granted shall cease and determine and anything
herein contained to be contrary notwithstanding and the said parties
of the first part for themselves and their heirs Executors and adminis
trators do covenant and agree to pay unto the said party of the
second part his heirs Executors or administrators or assigns all reason-
able attorneys fees & all costs changes & Expenses which the party of the
second part may incur or be put to in collecting by foreclosure
