David Proskey To John H. Brown

State of Florida }
Alachua County   } Whereas I David Proskey of Said County
and State am justly indebted to John H. Brown of the same place in the
Sum of One Thousand ($100000} dollars which said Sum of money is
covenanted to be paid by a certain promissory note bearing even date
herewith one for the Sum of One Thousand Dollars due one year
after date payable to John H. Brown or order given by David
Proskey by his attorney in fact A.S. Proskey. And whereas I
I am desirous of fully and better Securing the payment of
Said note and the Sum of money mentioned therein
Therefore Know all men by these presents that I David Proskey
by my said Attorney in fact A.S. Proskey for and in Consideration
of the premises and of the sum of one dollar to me in hand
paid have granted bargained and sold and by these presents
do grant bargain Sell and Convey unto the Said John H.
Brown his heirs and assigns all the following described piece
parcel or tract of land to wit: All those lots tracts or parcels of
land Situate lying and being in the County of Alachua and State
of Florida and described on the U.S. Survey as the north
East quarter and the South East quarter of the north West
quarter of Section Thirty One (31) in Township Eight (8) South
of Range Twenty Two (22) East Containing (80) Eighty
Acres more or less Being the same property sold
by Richard and Elizabeth Lee to David Proskey
August 4th 1881 And recorded in the Record of Deeds
of Alachua County Florida in Deed Book "M" at pages
797 - 798 & 799 on 24th day of October AD 1881 Also the
Rice Mills & Machinery Dwelling and other Buildings on Said
premises Together with all and Singular the tenements
hereditaments and appurtenances thereunto belonging To
have and to hold the same unto the said John H. Brown & his
heirs and assigns in fee simple absolute forever Provided
however and these presents are on this express consideration
that if the said David Proskey or his administrators
heirs or assigns shall well and truly pay or cause to be
paid the sum of money covenanted to be paid by said
Note together with the interest to accrue thereon according
to the legal tenor thereof then this obligation shall become
null and void else to remain in full force and Virtue
And it is hereby further agreed and stipulated that the
Said David Proskey or his heirs will pay all expenses
Costs and attorneys fees which the said John H. Brown
May be put to in enforcing the Collection of the aforesaid Sum
of money Covenanted to be paid by Said note by foreclosure
or otherwise
In witness whereof I have herewith set my hand and
