Mitchel Ervin for him and his heirs Executors
administrators does hereby covenant to and with the said
Horace Tarbox and his assigns that he is lawfully
possessed of said goods and chattels of his own prop-
erty: that the same are free from all incumbrances and
that he will warrant and defend the same to the said
Horace Tarbox and his assigns against the lawful
claims and demands of all persons Provided nevertheless
that if the said Mitchel Ervin shall well and truly pay
or cause to be paid unto the said Horace Tarbox or
his assigns the sum of one Hundred dollars according
to the tenor and effect of his certain promissory note
to wit  Ten months after date for the value received I promise
to pay H. Tarbox or order one Hundred Dollars
with interest at ten per cent until paid, then this
Mortgage is to be void otherwise to remain in full force
and effect and provided further that until default
is made by the said Mitchel Ervin in the performance
of the condition aforesaid it shall and may be lawful
for him to retain the possession of the said goods and
Chattels and to use and enjoy the same free of expense
to the party of the second part for taking care of the
same but if the same or any part thereof shall be attached
or claimed by any other person or persons at any time
before payment or the said Mitchel Ervin shall attem
pt to remove said goods and chattels out of said
county or to sell the same without the authority and
permission of the said Horace Tarbox or his assigns 
in writing expressed or if default shall be made in
the payment of said note or if the said Horace Tarbox
shall at any time before the maturity of said note
deem himself unsafe then it shall and may be lawful
for the said Horace Tarbox or his assigns to take
imediate and full possesion of the whole of the said
goods and Chattels In witness whereof the said Mitchel
Ervin has hereunto set his hand and seal this 19th
day of January AD 1878 }
