Malphurs and in favor of Samuel H. Burnett. And wheres
we are desirous of fully and better securing the payment of
said note and the sum of money mentioned therein, Therefore
know all men by these presents that we Joseph M. Malphurs
Laura A. Malphurs his wife and Joseph W. Malphurs
for and in Consideration of the premises and of the sum 
of One dollar to them in hand paid have granted bar-
gained and sold and by these presents do grant bargain
sell and convey unto the said Samuel H. Burnett his heirs
and assigns all the following described piece parcel or tract
of land to wit: North west Quarter of south East Quarter and
West half of South West Quarter of South East Quarter of
Section Four (4) Township Seven (7) South of Range (19) Nine-
teen East Containing (60) Sixty acres more or less - Also
five head of Cattle two Cows and Calves and heifer marked
Single split in each ear Branded Jay and figure two (J.2)
Also 1 Horse aged about three years old named Fanny
Together with all and singular the tenements hereditam-
ents and appurtenances thereunto belonging To have and
to hold the same unto the said Samuel H. Burnett
in fee simple absolute forever. Provided however and
these presents are upon this express Consideration that if
the said Joseph W. Malphurs Laura A. Malphurs his
wife and Joseph W. Malphurs their heirs and assigns shall
well and truly pay or cause to be paid the sum of money
Covenanted to be paid by said note together with the in-
terest to accrue thereon according to the legal tenor thereof
then this obligation shall become null and void else to
remain in full force and virtue. And it is hereby further
agreed and stipulated that the said Joseph M.
Malphurs Laura A. Malphurs and Joseph W.
Malphurs will pay all expenses Costs and attorneys
fees which the said Samuel H. Burnett may be put
to in enforcing the Collection of the aforesaid Sum of
money covenanted to be paid by said Note by fore-
closure or otherwise.
In Witness Whereof we have hereunto set our hand and
affixed our seals on the 1st day of February AD 1882
