John B. Starling to Eli Futch

Alacua County } Know all men by these presents that
whereas John B. Starling is indebted to Eli Futch Both of
the County and State aforesaid in the sum of one
Hundred Dollars lawful money of the United States which
said sum is expressed in one certain promissory note
bearing date January 10th 1883 and for the said sum
of one Hundred dollars together with interest at 12% pr
ct per annum now therefore to better secure said
Eli Futch in full payment of said note and interest
as expressed I do by these presents grant bargain sell
and convey unto the said Eli Futch his heirs and assigns
all my right title interest and claim to thirty head of
stock cattle knowned and described as follows marked
under square in one Ear and under bit in the other
Branded with a single Heart. To have and to hold all
and singular the personal property above bargained
and sold unto the said Eli Futch his heirs or executors
or assigns forever Provided nevertheless that if the said
John B. Starling should well and truly pay or cause to be
paid unto the said Eli Futch the full amount of said
note together with the interest according to the tenor and
effect then this instrument to void else to remain in
full force and virtue and it is hereby agreed further
that should it become necessary to enforce this instrument
by legal proceedings the said John B. Starling will pay there
for all attorneys fees and court charges that may accrue in
collecting said note & mortgage In witness whereof I have
hereunto set my hand and affixed my seal this the
10th day of January AD 1883.

B. Starling sign seal and deliver the foregoing instrument
of writing for the uses and purposes as therein contained
