conveyed that he has a good and lawful
right to sell and convey the same and that
the same is free from all encumbrances and that
he will and his heirs and assigns shall and
will forever warrant and defend the same unto
the party of the second part and his heirs and
assigns against the lawful claims of all other
persons whatsoever. Provided nevertheless that
if the said party of the first part pays or causes
to be paid to the party of the second the amount
of a certain promissory note made by the party
of the first part to the party of the second part
or bearer bearing Ten per cent interest per annum
from date and dated January 1st 1883 and due
one day thereafter for the sum of one Hundred
and thirty dollars then the above indenture
deed or obligation to be utterly void and otherwise
to remain in full force.

the first part has hereunto set his hand and
seal the day and the year above written
