Benjamin Roberts and Wife to H.C. Parker
"Mortgage"
State of Florida } Know all men by these presents that whereas
Alachua County } Benjamin Roberts & Elizabeth Roberts his wife of the
above State County is indebted to H.C. Parker of the same State
and County in the sum of One Hundred and Twelve dollars which
said sum is covenanted to be paid by their certain promissory note
bearing date February 16th 1883 and for the said sum of one Hundred
and Twelve dollars Now therefore to better secure the payment of said note
as expressed therein we do by these presents grant bargain sell and convey
unto the said H.C. Parker his heirs and assigns all my right title
interest and claim of in and to all the crops of whatsoever species
kind or description now growing or which may hereafter be planted
grown or gathered by me or for me or for my benefit on or off of any
and all lands in Alachua County Florida also the following
described property to wit: One Bay Mare about 10 years old named Kate
one Grey mare about four years old named Fannie, Five head of
cattle marked swallow Fork in one Ear and crop and half crop in the
other ear To Have and to Hold all and singular the crops lands and
personal property above bargained and sold unto the said H.C. Parker
his heirs executors administrators and assigns forever. Provided neverthe-
less that if the said Benjamin Roberts & Elizabeth Roberts should well and
truly pay or cause to be paid unto the said H.C. Parker the full
amount of said note according to its tenor and effect then this
instrument to be void else to remain in full force and virtue
And it is hereby further agreed that Should it become necessary to
enforce this instrument by legal proceedings the said Benjamin Roberts
& Elizabeth Roberts will pay therefore all attorneys fees charges and
expenses. In Witness Whereof we have hereunto set our hands and
affixed our seal this 16th day of February AD 1889
