grant bargain and sell to the said party of the second part
his heirs and assigns all those certain tracts or parcels of land
lying in the County of Alachua and State of Florida described
on a plat of the "Leitner land" in said County and State made
by William C. Miller and designated as Lots Numbers (51) Fifty
one (47) Forty seven (48) Forty Eight (33) Thirty three and
North fractional part of Lot No (54) Fifty four lying North
of what is properly called "saw Grass pond" and "Wauberg
Lake Each of said Lots containing Forty acres of land more
or less except said Lot No (54) Fifty four from which about
ten acres have been heretofore conveyed by Messrs Matheson
and McMillan as Trustees to one James B. Brown lying
south of said saw Grass Pond all of said Lots of land
being a part of what is commonly known as the "Leitner
Place" situate in said County and State in what is desig
nated in Map of the Arredondo Grant made by Burr and
Washington as Lot or section nine of the Moses E. Levy Grant and
containing one hundred and ninety acres more or less Together
with all and singular the tenements hereditaments thereunto belonging
or in any wise appertaining and the reversion and reversions remain
der and remainders rents issues and profits thereof and also all
the estate right title interest Dower and right of dower property
possession claim and demand whatsoever as well in law as in
equity of the said parties of the first part of in and to the
same and every part and parcel thereof with the appurtenances
To have and to hold the above granted bargained and
described premises with the appurtenances unto the said party
of the second part his heirs and assigns to his own proper
use benefit and behoof forever Provided Always and these presents
are on this express condition that if the said F. Lewis Seldon his
heirs executors or administrators shall well and truly pay unto the
said party of the second part his heirs executors administrators or
assigns the said sum of three thousand five hundred dollars
mentioned in a certain promissory note bearing even date here
with with interest according to the time intent and meaning
thereof together with all the costs charges and expenses including
reasonable attorneys fees and commissions which the said party
of the second part may incur or be put to in collecting the same
by foreclosure or otherwise and shall pay all taxes and
assessments levied or assessed on said mortgaged premises
and shall comply with all the covenants contained in this
Mortgage and pay all the monies secured thereby that then
these presents and the estate hereby granted shall cease
and determine and be absolutely null and void and
the said parties of the first part of themselves and their
heirs executors and administrators do hereby promise cove
nant and agree to pay to said party of the second part
his executors administrators or assigns the said sum of
