sign seal and deliver the foregoing instrument of writing
for the uses and purposes as therein contained and expressed

          Cato Thomas To Saml D. Smoke

Alachua Florida  } Know all men by these presents that
whereas Cato Thomas of the above State and County is indebted
to Saml D. Smoke of the same State and County in the
sum of Thirty seven dollars which said sum is coven
anted to be paid by a certain promissory note bearing date
and for the said sum of Thirty seven dollars balance due
bearing interest at the rate of ten per cent Now therefore to
better secure the payment of said note and interest as express
ed therein I do by these presents grant bargain sell and con
vey unto Saml D. Smoke his heirs and assigns all my right
title interest and claim of in and to all the crops of what
soever Species kinds or description now growing or which
may hereafter be planted grown or gathered by me or for me
or for my benefit on or off of any and all land in Alachua
County Florida also the following described property to wit:
One old Black mare To have and to hold all and singular
the crops lands and personal property above bargained and
sold unto the said Saml D. Smoke his heirs executors admin
istrators and assigns forever Provided nevertheless that if the
said Cato Thomas should well and Truly pay or cause to be
paid unto the said Saml D. Smoke the full amount of said
note Together with the interest according to its tenor and
effect then this instrument to be void else to remain in full
force and virtue and it is hereby further agreed that should
it becomes necessary to enforce this instrument by legal
proceedings the said Cato Thomas will pay therefor all attorneys
fees charges and expenses In witness whereof I have hereunto
set my hand and affixed my seal this sixteenth day
of December AD 1882.        }
