Deed of Trust
Know all men by these presents that whereas I J Adger Clark
of the town of Ashville in the State of North Carolina
is justly indebted to Harriet Champion of the Town of Plain
field in the State of New Jersey in the sum of Four Thousand
Dollars as evidenced by his note under seal for that amount
and bearing even date with these presents and whereas the
said J. Adger Clark is desirous of securing the said
note now therefore for and in consideration of the premises
and in further consideration of the sum of Five Dollars
to him in hand paid by W.R. Penniman Jr of Ashville
aforesaid the receipt whereof is hereby acknowledged
the said J. Adger Clark hath bargained and sold and by
these presents doth bargain sell and convey unto the
said W.R. Peniman Jr and his heirs all that piece or
parcel of land lying and being in the County of Alach
ua State of Florida and bounded as follows to wit Begin
ing at a post in the north west corner of said
tract and runs south 990 feet to a post marked
"AI" thence East 361 feet to a stake Thence south 906
feet thence west about 153 feet to a fence thence
with said fence northwestwardly to a corner marked
"O" being 455 feet south of the stake marked AI thence
west to the waters or Orange Lake Thence with the shore
of Orange lake to stake marked "X" on the shore of the lake
Thence East to the south gate post leading into the Grove
thence North with the present fence about 400 feet to the
fence on the north side of the Grove thence East 759 feet
to the beginning it being the orange Grove property conveyed
to the said J. Adger Clark by George R. Fairbanks and
wife by deed bearing date the 2nd day of January
1882 AD and recorded in the Public Records of Alachua
County Florida in Book "N" pages 12 et seq To have
and to hold the aforesaid tract or parcel of land with
all the appurtenances thereto belonging unto the said W.R. Penn
iman Jr and his heirs to his and their only use and be
hoof forever In Special Trust and confidence neverthe
less and for the following purpose to wit the security
of the said note of Four Thousand Dollars aforesaid
and if the said J. Adger Clark shall pay or cause to
be paid the interest on said sum at the end of every
six months according to the provisions of said note
and principal when it becomes due then these presents
are to become null and void otherwise to remain in
full force and effect and the said W.R. Penniman Jr
shall and may at any time after failure to pay any
