property above bargained and sold unto the said
Horace Tarbox his heirs executors administrators and
assigns forever. Provided Nevertheless that if the said
Wm Pendarvis Should well and truly pay or cause to be
paid unto the said Horace Tarbox the full amount of
said note together with interest according in its tenor
and effect then this instrument to be void else to remain
in full force and virtue.
And it is hereby further agreed that should it become
necessary to enforce this instrument by legal proceedings
the said Wm Pendarvis will pay therefor all attorneys
fees charges and expenses

of Butler County Alabama in the Sum of Eight
hundred dollars which said sum of money is
Covenanted to be paid by Two Certain promissory notes
bearing even date herewith one for the Sum of Four hun-
dred dollars payable on or before the first day of
January AD 1884 and the other one for the Sum of
Four hundred dollars payable on or before the first
day of January AD 1885, both hearing interest
from date at the rate of eight per Cent per annum
