containing by estimation One acre of land more or less 
together with all and singular the tenements heredita-
ments and appurtenances to the same belonging or in
anywise pertaining. To have and to hold unto him the
said Burt C. Drake and to his heirs, executors, admin-
istrators and assigns forever. 
                           Provided always nevertheless
and this instrument is executed and delivered upon this
expressed condition that if I, the said Carinus B. Dodd,
shall and do well and truly and fully pay the said
promissory note for the sum of One Thousand Dollars
at the time and date the same falls due, and shall
also, well and truly and fully pay each installment
of interest semiannually to fall due upon said
promissory note at the times and dates when said
installments shall fall due respectively, then this
instrument to become null and void otherwise to be
and remain in full force and virtue, And it is here
by expressly stipulated and agreed that in the event the
semiannually installments of interest on said note shall
not be promptly paid at the time each semiannual
installment shall fall due that in case of such default
the said promissory note shall be deemed and held to be
all due, principal and interest within five (5) days
after such default in the payment of any semiannual
installment of interest and the said Burt C. Drake
in such event shall have the right, if he so desire, at once to
foreclose this instrument for the collection of both prin-
cipal and interest upon said note.
                    And it is hereby further stipulated
and agreed that in the event of any necessity arising
for the enforcement of this instrument by foreclosure
that then the said Carinus B. Dodd will pay rea
sonable attorneys fees and all costs and charges for
such foreclosure the same to be considered and treated
as part of the indebtedness secured to be paid hereby
and the same to be collected under such foreclosure
hereof. In witness whereof we have hereunto set our
