C.A. Simmons To Frank W. Simmons
"Mortgage"
This Indenture made this Ninth Day of April in
the year of our Lord One Thousand Eight Hundred And
Eighty Three between Cicero A. Simmons and
Martha M. Simmons his wife, of the first part And
Frank W. Simmons of the second part. Whereas, the
said C.A. Simmons is justly indebted to said Frank
W. Simmons of the second part in the sum of Four
Thousand Dollars lawful money of the United States
of America, as will more fully appear by by his notes of even
date herewith to wit: four promissory notes for One Thousand
Dollars Each Due Two years from the date hereof with
with interest at the rate of eight per cent
Now this Indenture Witnesseth that the said party
of the first part for the better securing the payment of
the said sum of money mentioned in said notes secured
by this mortgage and in this mortgage, and also for and in
consideration of the sum of one Dollar to him in hand
paid by the said party of the second part at or before
the ensealing and delivery of these presents the receipt
whereof is hereby acknowledged has granted, bargained, sold
aliened, remised, released, conveyed, and confirmed, and by
these presents does grant, bargain, sell, alien remise, release
convey and confirm unto the said party of the second
part, his heirs and assigns forever. All of one undivided
half interest in the West Half (1/2) and the South East
(1/4) Quarter (1/4) of Section Thirty One (31) Township (10)
Ten, South Range (22) Twenty Two East-----
Together with all and singular the tenements hereditaments
and appurtenances thereunto belonging or in anywise
appertaining and the reversion or reversions remainder
and remainders rents issues and profits thereof.
And also all the right title, interest now owned or here
after to be acquired, and the property possession claim and
Demand whatsoever as well in law as in equity of the
said party of the first of, in, and to the same and every part
and parcel thereof with the appurtenances:
To have and to hold the above granted and described premises
unto the said party of the second part his heirs, and assigns
to his own proper use benefit and behoof forever.
Provided always, and these presents are on this express condi-
tion that if the said party of the second part his heirs executors
administrators or assigns, shall well and truly pay
unto the said party of the second part his heirs executors
or administrators or assigns the said sum of money in said
notes and this Mortgage mentioned with interest according to
the true intent and meaning thereof, together with all costs

For and in Consideration of the full payment of the money secured to be
paid by this mortgage I hereby cancel and discharge the Same from record this
5th day of June AD 1888
