David and Eliza Brown to Charles W. Bauknight
"Mortgage"
This Indenture made this Fifth day of May in the year of our
Lord one thousand eight hundred and eighty three Between David Brown
and Eliza Brown Parties of the first part and Charles W. Bauknight
merchant Party of the second part: Whereas the said David & Eliza
Brown - Justly indebted to Charles W. Bauknight Merchant of the
second part in the sum of Forty Dollars lawful money of the United
States of America. Now this Indenture witnesseth that the said
parties of the first part for the better securing the payment of the
said sum of money mentioned in the within and also for and
in consideration of the sum of Forty Dollars to us in hand
paid by the said party of the second part at or before the ensealing
and delivery of these presents the receipt whereof is hereby acknowledged
do hereby granted bargained sold aliened remised released conveyed
and confirmed and by these presents do grant bargain sell alien
remise release convey and confirm unto the said party of the second
part and to his heirs and assigns forever all that certain tract or
parcel of Land viz The South West1/4 of North West1/4 of Sec 20 in
Township 10 S of Range 18 E Containing 40 02/100 acres said tract
of land received by Ruthy Wood widow of Reuben Wood from the
United States Government as a homestead by virtue of final
receivers Receipt No67 - Signed by S.F. Halliday Receiver Oct 3rd 1873 and
by the said Ruthy Wood convey to David Brown and Eliza Brown in
consideration of an exchange of homesteads, Also 3 head of cattle
mark crop & two splits in one ear and two splits in the other Branded
DB, Also 12 head of Stock hogs marked crop and two splits in
one ear and two Splits in the other Also all the general growing |
