crop planted & cultivated by the said parties of the first part for
the year 1883 Together with all and singular the tenements hereditaments
and appurtenances thereunto belonging or in anywise appertaining
and the reversion and reversions remainder and remainders rents issues
and profits thereof and also all the estate right title interest
property possession claim and demand whatsoever as well in law as
in equity of the said parties of the first part of in and to the same
and every part and parcel thereof with the appurtenances. To Have and
to hold the above granted and described premises unto the said party
of the second part his heirs and assigns to their own proper use
benefit and behoof forever. Provided always and these presents are
on this express condition that if the said David and Eliza Brown their
heirs executors or administrators shall well and truly pay unto the
said party of the second part and to his heirs executors or
administrators or assigns the said sum of money, Forty Dollars on
1st day of Decb 1883 with interest according to the true intent and
meaning thereof together with all costs charges and expenses including
reasonable attorneys fees and commissions, which the said party
of the second part May incur or be put to in collecting the same by
foreclosure or otherwise and shall pay all taxes and assessments levied
or assessed on said mortgaged premises and personal property mentioned
within and shall comply with all the covenants contained in this
mortgage and pay all the moneys secured thereby that then thes presents
and the estate hereby granted shall cease determine and be absolutely null and
void and the said parties of the first part for themselves and their heirs
executors and administrators do hereby promise covenant and agree to pay to the
said party of the second part and his Executors administrators or assigns
the said sum of money and interest as mentioned in said Mortgage and
secured to be paid as aforesaid and if default shall be made in the payment
of the said sum of money or any part thereof as provided in the said Mortgage
or if the interest that may be due thereon or any part thereof shall be due
and unpaid for the space of December 1st 1883 then and from henceforth it
shall be optional with the said party of the second part his executors
administrators or assigns to consider the whole of said principal sum expressed
in said mortgage as due and payable and the said parties of the first
part hereby covenant promise and agree to and with the said party
of the second part to pay all taxes and assessments that maybe levied or
imposed upon the said premises and upon the personal property
during the continuance hereof and to pay all costs charges and
expenses in collecting the moneys hereby secured including reasonable
attorneys fees and commissions whether collected by foreclosure or otherwise
and any and all sums of money paid out by the said party of the
second part by reason of the default of the parties of the first part to
pay the money so stipulated or to comply in any respect with the covenant
of this mortgage shall draw interest at the same rate as the aforesaid
and said moneys necessarily paid by the party of the second part shall
be secured by this mortgage. And the said parties of the first part
hereby waive all right of homestead and exemptions granted by the
