they hold my promissory note for said sum of Five
Hundred and whereas I did heretofore to wit on the 30th day
of April 1883 make and execute to the said Taylor & Sanchez
a certain deed of Mortgage for the consideration of said Mort
gage expressed and for the purpose of securing the pay-
ment of said note and whereas I conveyed to them or attem
pted thereby to convey to them certain Lands to secure said
and whereas it appears from an inspection of the records
of the United States office and from the Patents and deeds
in my possession that there was a mistake in the descrip
tion of the lands as described and set forth in the mort
-gage heretofore on the 30th of April made executed and
delivered by me to the said Taylor and Sanchez and whereas
I am desirous of Correcting said mistake in the description
and desirous of securing the payment of my said note there
-fore in consideration of the premises and in consideration
of my promissory note of Five Hundred dollars dated April
30th 1883 given to and held by Taylor and Sanchez, payable six
months after the date thereof and for and in consideration
of the sum of five dollars to me in hand paid by
Taylor and Sanchez, I have this day granted bargained and
sold and by these presents do grant, bargain, sell, alien,
and convey unto the said Taylor and Sanchez the following
described Lands Land lying and being situated in Alachua County
Florida to wit: The South East Quarter of the South West Quar
ter, and the South East Quarter of the South East of Sec
tion (32) Thirty Two in Township Ten (10) South of Range
(18) Eighteen East and the North West Quarter of the North
West Quarter of Section (4) four in Township (11) Eleven South
of Range Eighteen East containing (120 02/100} one hundred and
twenty and two one hundredths acres more or less and also the
following personal property to wit all of my stock of cattle num
bering Thirteen head More or less marked under and upper
bit in Each Ear branded P.S. Four (4) head of grown Horses
and five head of Colts, Thirty acres of Cotton and forty
five acres of corn now growing on the above described lands
in Alachua County Fla. To have and to hold the above
described property unto the said Taylor and Sanchez and
to their heirs and assigns forever, Upon this expressed
condition that if the said Peter Spann shall well and
truly pay or cause to be paid, the within described promis
sory note at its maturity, and shall well and truly pay
all attorneys fees and costs of Court, that may be incurred
in the event of a foreclosure of this Mortgage, which
the said party of the first part hereby agree to pay, then this
obligation to be void. Else to remain in full force and
virtue Witness my hand and seal on this the first day
