Thos W. Downing To H.F. Dutton and Co

State of Florida }        Know all men by these
Alachua County   }  presents That whereas I, Thos
W. Downing of the above State and County am indebt-
ed to H.F. Dutton & Co of the same State and County
in the sum of One hundred dollars which the said
sum of money is covenanted to be paid by one certain
promissory note bearing date 4th June 1883 for the said
sum of One Hundred dollars bearing interest at the rate
of Two per cent per month after maturity. Now therefore
to better secure the payment of said note and interest
expressed therein I do by these presents, grant, bargain,
sell and convey unto the said H.F. Dutton & Co their
heirs and assigns all my right, title, interest and claim
of in and to all crops of whatsoever species kind or de
scription, now growing, or which may hereafter be planted
grown or gathered by me or for me or for my benefit on
or off of any and all lands in Alachua County Florida
Also the following described property to wit ----
To have and to hold all and singular the crops, lands
and personal property above bargained and sold unto
the said H.F. Dutton & Co theirs heirs executors admin
istrators and assigns forever. Provided nevertheless, that if
the said Thomas W. Downing should well and truly pay or
cause to be paid unto the said H.F. Dutton & Co the full
amount of said note together with interest according to
its tenor and effect, then this instrument to be void, else
to remain in full force and virtue. And it is hereby fur
ther agreed that should it become necessary to enforce this
instrument by legal proceedings the said Thomas W.
Downing will pay therefor all attorney's fees and expenses
