Charles H. Breedlove to Wm A. Toffiez

State of Florida }
Alachua County   }  Whereas I Charles H. Breedlove
of the aforesaid County and State am justly in-
debted to William A. Toffiez of the Same place in
the Sum of One hundred and fifty dollars which
Said Sum of money is covenanted to be paid by a
certain promissory note bearing even date herewith
one for the Sum of One hundred and fifty dollars
of date August the Seventh AD 1883 payable to the
order of William A. Toffiez given by the said Charles
H. Breedlove due Thirty days after date thereof with
interest from the date thereof at the rate of 24% pr
annum Being for the purchase money of and for
the property hereinafter described.
And whereas I am desirous of fully and better
securing the payment of said Note and the Sum
of Money mentioned therein. Therefore Know all men
by these presents that I the said Charles H. Breed-
love for and in Consideration of the premises and of
the sum of one Dollar to me in hand paid have
granted bargained and Sold and by these presents
do grant bargain sell and Convey unto the said
William A. Toffiez his heirs and assigns all the
following described property to wit: Two (2) Roan
mares and one (1) Colt about five months old -
To have and to hold the Same unto the said William
A. Toffiez in fee simple absolute and forever
Provided however and these presents are upon this
express condition Consideration that if the said
Charles H. Breedlove or his heirs and assigns shall
well and truly pay or Cause to be paid the Sum of
money Covenanted to be paid by said note together
with the interest to accrue thereon according to the legal
tenor thereof then this obligation shall become null
and void else to remain in full force and virtue
And it is hereby further agreed and stipulated that
the said Charles H. Breedlove will pay all expenses
costs and attorneys fees which the said William
A. Toffiez may be put to in enforcing the Collection
of the aforesaid Sum money covenanted to be
paid by said note by foreclosure or otherwise
In Witness Whereof I have hereunto set my hand
and affixed my seal on this Seventh (7th) day of
