And Also all the Estate right title interest Dower and right of Dower
property possession claim and demand whatsoever as well in law as
in Equity of the said party of the first part of in and to the Same
and every part and parcel thereof with the appurtenances. To Have
and to Hold the above granted and described premises unto the said
party of the second part his heirs and assigns for his own proper use
benefit and behoof forever Provided always and these presents are on
this express condition that if the said Manuel Entenza or his heirs
executors or administrators shall well and truly pay unto the said
party of the second part or his heirs executors administrators or assigns
the said sum of money mentioned in said promissory note with
interest according to the true intent and meaning thereof with all
costs charges and expenses including reasonable attorney's fees and
commissions which the said party of the second part may incur or
be put to in collecting the same by foreclosure or otherwise and
shall pay all taxes and assessments levied or assessed on said mortgaged
premises and shall keep said mortgaged premises insured
against fire and shall comply with all the covenants contained in
this Mortgage and pay all the moneys secured thereby that then these
presents and the estate hereby granted shall cease determine and
be absolutely null and void and the said party of the first part
for himself and his heirs executors and administrators does hereby
promise covenant and agree to pay to the said party of the second
part or his heirs executors administrators or assigns the said sum of
money and interest as mentioned in said promissory note and secured
to be paid as aforesaid and if default shall be made in the
payment of the said sum of money or any part thereof as provided
in the said promissory note or if the interest that may become
due thereon or any part thereof shall be due and unpaid for the
space of Ten days then and from thence forth it shall be optional
with the said party of the second part or his heirs executors
administrators or assigns to consider the whole of said principal
sum expressed in said promissory note as due and payable
and the said party of the first part hereby further covenants promises
and agrees to and with the said party of the second part
to pay all taxes and assessments that may be levied or imposed
upon the said premises and all cost of insurance during the
continuance hereof and to pay all costs charges and expenses
in collecting the moneys hereby secured including reasonable
attorneys fees and commissions whether collected by foreclosure or
otherwise and any and all sums of money paid out by the
said party of the second part by reason of the default of the
party of the first part to pay the money so Stipulated or
to comply in any respect with the covenants of this Mortgage
shall draw interest at the same rate as the Sum of Money
mentioned in the note aforesaid and said money's necessarily
paid by the party of the second part shall be secured by this
mortgage And the said party of the first part hereby waives
