law as in equity of the said parties of the first
part of in and to the same and every part and par
cel thereof with the appurtenances To have and to
Hold the above granted and described premises unto
the said party of the second part her heirs and ass
igns to her and their own proper use benefit and
behoof forever provided always and these presents
are on this express condition that if the said
Lucy H. Eastman and John C. Eastman or their
heirs executors or administrators shall well and
truly pay unto the said party of the second part
her heirs executors administrators or assigns the
said sum of money mentioned and set forth in the
said note Together with interest according to the
true intent and meaning thereof Together with all
costs charges and expenses including reasonable attor
neys fees and commissions which the said party of the
second part may incur or be put to in collecting
the same by foreclosure or otherwise and shall pay all
taxes and assessments levied or assessed on said Mor
tgaged premises which may now be due thereon
and which shall hereafter become due at any time
until the said note and mortgage shall have been
paid in full and shall comply with all the covenan
ts contained in this mortgage and pay all the moneys
secured thereby thus then these presents and the estate
hereby granted shall cease determine and be absolutely null
and void and the said parties of the first part for them
selves and their heirs executors and administrators do here
by promise covenant and agree to pay to the said par
ty of the second part their executors administrators or
assigns the said sum of money and interest as men
tioined in said note and secured to be paid as afore
said And if default shall be made in the payment
of the said sum of money or any part thereof as
provided in the said note & this mortgage or if the
interest that may become due thereon or any part
thereof shall be due and unpaid for the space of sixty
(60) days then and from thence forth it shall be option
al with the said party of the second part her execut
ors administrators or assigns to consider the whole of
said principal sum expressed in said promissory
note as due and payable and the said parties
of the first part hereby further covenant promise
and agree to and with the said party of the second
part to pay all taxes and assessments that may
be levied or imposed upon said premises during the
continuance hereof by lawful authority and to pay all
