to the party of the second part the above men-
tioned sum of Two Thousand dollars this day
advanced to him by the party of the second part
and for which sum of money he hereby acknowl-
edged himself legally and honestly indebted to
the party of the second part together with the
interest thereon at the rate of Ten per cent per
annum from the date of this instrument untill
paid and further agrees to pay or cause to be paid
to the party of the second part the interest on the
said sum of Two Thousand Dollars as it accrues
from time to time annually on the Ninth day of
October of each year and hereby further
agrees to pay all Costs and reasonable attorneys
fees of it should ever become necessary for the
party of the second part by reason of his default
in not liquidating the indebtedness above men-
tioned according to the terms above expressed
provided allways nevertheless that if the said
Josiah T. Walls shall well and truly pay or Cause
to be paid to the party of the second part his heirs
executors administrators successors or assigns the
said Sum of Two Thousand dollars with the inter-
est therein according to the tenor and effect of
this instrument then this obligation to be void else
to remain in full force and virtue
