T.R. Waits To R.B. Smith
"Mortgage"
This Indenture made the Fifth day of October
AD 1883 between Thomas R. Waits and his wife Emma L.
Waits ^ in her own right ^ both of the County of Alachua
and State of Florida and Russell B. Smith also of said
State and County party of the second part witnesseth
that whereas the said Thomas R. Waits is justly indebted
to said Russell B. Smith in the sum of Two hundred
dollars as will more fully appear by his promissory
notes of even date herewith for the better securing of
which this mortgage is given to wit one note for One
hundred dollars payable October 6. 1884 and the
Other October 6 1885 also for one hundred dollars with
interest at ten per Cent a year. Now therefore said
Thomas R. Waits and Emma L. Waits parties of the first
part for the better securing of said notes and also for and
in Consideration of the Sum of one dollar to them in hand
paid at and before the sealing and delivery of these pres-
ents the receipt whereof is hereby acknowledged have
granted bargained sold Conveyed and confirmed and by
these presents do grant bargain sell assign Convey and Con-
firm and set over to the Said party of the Second part
his heirs and assigns forever all of the South East Quarter
of the North East Quarter of Section (16) Sixteen Township
(10) Ten South Range Twenty Two (22) East Containing forty
acres more or less together with all and singular the
tenements hereditments and appurtenances thereunto
belonging or in anywise appertaining. To have and to hold
the above granted and described premises to the said
party of the second part his heirs and assigns forever
Provided always and these presents are on this express
Condition that if the said Thomas R. Waits his heirs
executors administrators or assigns the said Sum of
money in this Mortgage and in said notes mentioned
shall well and truly pay then these presents and the
estate hereby granted shall cease determine and be
absolutely null and void. In Witness whereof the
said parties of the first part have hereunto set their
hands and seals the day and year first above

For value received I hereby acknowledge full payment settlement
and discharge of this mortgage this the 17th day of January AD 1884
