To have and to hold the said lands with all their
appurtenances unto the said party of the Second
part his heirs and assigns to his and their only
use and behoof forever-: But on this special
trust: That he will hold the Same as security for
the payment of said note and the interest that
may become due thereon and if the same with all
the interest thereon shall be paid as the Same shall
be payable then this Conveyance shall be void and
the said parties of the second and third parties
shall execute to the party of the first part his
heirs and assigns a full and Complete release
and acquittance of all interest in said lands by
Virtue hereof: But if default be made in the pay-
ment of either or any installment of interest or of
the principal of said note when the same shall
become due and such default shall Continue for
thirty days then it shall be the duty of the party
of the second part his heirs successors and assigns
at the request of the party of the third part his heirs
or assigns to sell said lands or so much thereof
as may be necessary at public auction on the
premises for cash first giving notice in some
newspaper (or if none is published at the Court
House door.) in the town of Gainesville Florida and
also at the Court House door in Ashville & then other
public places in Buncombe County for forty days
of the time & place of sale and out of the proceeds
