Talbott and Sons to C. Constine & E.C. DuBose
"Agreement"
An Agreement made and entered into by and between Talbott &
Sons of the City of Richmond State of Virginia of the one part and
C. Constine & E.C. DuBose of the other part: Witnesseth that the said
Talbott & Sons agree to furnish said C. Constine & E.C. DuBose the
following articles viz: One 30 HP Side Crank Standard Engine
one 40 HP Locomotive Boiler 1 No 2 Saw Mill with 3 Ratchet Head
Blocks & 30 ft of carriage 54 in Saw 130 ft 12 in 4 ply gum Belting
15 ft 3 in turned Shafting 3 clamp boxes 2 loose Collars for same
2 Iron Pullies 112 x 48 in 112 x 60 in flanged & Bolts to fit 3 in Shaft
to be ready for delivery on Car at Richmond Va on or about the 15"
day of September 1883 for the consideration of the payment of Three
thousand One Hundred and forty nine Dollars as follows
Freight on machinery from Richmond to Shipping point to be paid
on arrival of same One thousand Dollars August 25 1993 in one
16 HP Taylor Engine & Boiler 1 Page saw Mill 1 30 in under runner
corn mill 2 circular Saws 1 pece shafting & Boxes 3 Iron Pullies to be
delivered free from freight bill Jany 1 1884 balance in note payable
1st Jany 1885 Note to bear date of Bill of Lading with 7 per cent
interest added. The condition of the above contract is that the
legal title and right of property in and to the above described
property is to remain and be vested in Talbott & Sons of Richmond Va
until the said note and all interest thereon accrued is paid
off; and in case the said Constine & DuBose should fail to
pay off the amount due by the said notes or either of them at
maturity then it shall be lawful for the said Talbott & Sons of
Richmond Va to take possession of the said property at any
time after the maturity of the said notes or either of them
but in case the said notes are paid off then the title of said
property to vest in the said Constine and DuBose Talbott & Sons
warrant the above described Machinery to be of good material and
workmanship and to perform in a satisfactory manner when
properly used said Constine & DuBose agree to pay traveling
expense of Man from Clio SC to place of erecting Machinery and
return. Man to Superintend setting up Machinery furnished
by Talbott & Sons free of charge except traveling expenses
It is understood that no warranty or verbal understanding of
any kind exist in regard to the present contract other than
what is herein expressly Stated In Witness Whereof the parties
hereunto have set their hands this 15 day of August AD 1883
