aforesaid of the second part Witnesseth that the said parties of the first
part for and in consideration of one dollar to them in hand paid
the receipt whereof they do hereby acknowledge and for the further
consideration of an open account with the said party to the second
part John T. Fleming Merchant for the year 1883, not to exceed One
Hundred and twenty six dollars ($12600) bearing 8 per cent Interest
from date hath this day bargained sold and delivered and by
these presents do hereby bargain sell deliver and convey unto the said
John T. Fleming merchant Lot No 8 or the North West quarter (NW1/4)
of the SW1/4 of section twenty two (sec 22) in Township Eleven
(T 11) South of Range Eighteen East containing 39 97/100 acres
under section 2291 of the Revised Statutes of the United States also
all the general growing crop consisting of corn cotton
vegetables potatoes &C cultivated and made by us for the
year 1883 To have and to the said described land and
general crop unto John T. Fleming his heirs and assigns as his
and their absolute property in fee simple forever Provided
Nevertheless the within is considered in the nature of a Mortgage
for the purpose of securing to John T. Fleming merchant the
payment of One hundred and Twenty six dollars ($12600) this
day credited to our account upon his books to enable us to
plant and cultivate the within crop for the year 1883, now if
we shall well and truly pay said amount with 8 per cent interest
from date on the first day of January AD 1884 then then this
to be null and void and in default of said payment and interest
at the time specified the within is to be considered a "Boni Fide"
Bill of sale and John T. Fleming merchant is hereby authorized
and duly empowered to take peaceable possession of said
described land and crop and for the further security of said
payment we do hereby voluntarily waive the benefits of the
homestead laws of the State of Florida. In Witness whereof
