Now this Indenture Witnesseth That the said parties of the first
part for securing the payment of the said money mentioned in the
said promissory note and moneys herein mentioned and in consideration
of the sum of one dollar to them in hand paid by the said party of
the second part at or before the delivery of these presents the receipt
whereof is hereby acknowledged have granted bargained sold released
conveyed and confirmed and by these presents do grant bargain sell
release convey and confirm unto the said party of the second
part and his heirs and assigns forever all the following
described land situate in the County of Alachua and State of
Florida described as follows Beginning at a point seventy Eight
yars South from NE Corner of SW1/4 of NW1/4 of S24 T9 SR22E
running thence South Two hundred and two yards to a Stake
thence West One hundred and Twenty five to a Stake thence
North Two hundred and two yards to a Stake thence East one
hundred and twenty five yards to the beginning containing five &
a half (5 1/2) acres more or less. Together with all and singular the
tenements houses and improvements thereon and thereunto belonging
or in anywise appertaining and all reversion remainders homesteads
rights issues and profits thereof And also the estate right
title interest property possession claim and demand whatsoever
as well in law as in equity of the said parties of the first part
of in and to the same and every part and parcel thereof with the
appurtenances: To Have and to Hold the above granted and described
premises unto the said party of the second part his heirs and
assigns. Provided always and these presents are on this expressed
condition that if the said parties of the first part their heirs
executors or administrators shall well and truly pay unto
the said party of the second part his heirs executors administrators
or assigns the said moneys according to the terms of said
promissory note and without any default of payment of any
interest or the principal when due according to the true intent
and meaning of said writing and in the mean time shall pay all
taxes legally assessed on said property before sale thereof for
non payment of taxes together with all costs charges and
expenses including a reasonable allowance for attorney's or Solicitors
services which the said party of the second part may incur
or be put to in collecting the said moneys by foreclosure or
suit then these presents and the estate hereby granted shall
cease determine and be absolutely null and void And the said
parties of the first part for themselves and their heirs executors
and administrators do covenant and agree to pay unto the said
party of the second part his heirs executors administrators or
assigns the said moneys with interest thereon to accrue said
taxes costs charges and expenses with said Attorney's or
Solicitor's charges the said party of the second part may incur
or be put to in collecting the same by foreclosure or suit and
to keep the taxes paid on said property while said money remain
