of America Now this Indenture Witnesseth that the said party of
the first part for the better securing the payment of the sum of
money mentioned in a promissory Note bearing even date with this
instrument and also for and in consideration of the sum of
Two Hundred and Fifty Dollars to them in hand paid by the said
party of the second part at or before the ensealing and delivery of these
presents the receipt whereof is hereby acknowledged have granted bargained
hold aliened remised released conveyed and confirmed and
by these presents do hereby grant bargain sell alien remise release
convey or confirm unto the said party of the second part and to his
heirs and assigns forever All the following described lands to wit:
The East half (E 1/2) of the South West quarter (SW 1/4) of Section Thirty one
(S31) Township Eleven (T11) Range Nineteen (R19) Eighty acres more or less
also The West half (W1/2) of South West quarter (SW1/4) Section Thirty one
(S31) Township Eleven (T11) Range Nineteen (19) S and E Containing
Eighty acres more or less Total 160 acres Together with all and
singular the tenements hereditaments and appurtenances thereunto
belonging or in anywise appertaining and the reversion and
reversions remainder and remainders rents issues and profits
thereof And also all the estate right title interest property
possession claim and demand whatsoever as well in law
as in equity of the said parties of the first part of in and to
the same and every part and parcel thereof with the
appurtenances To have and to hold the above granted and
described premises unto the said party of the second
part his heirs and assigns to his & their own proper use
benefit and behoof forever Provided Always and these presents
are on this express condition that if the said Frank Danzy and
Luna Danzy their heirs executors or administrators shall
well and truly pay unto the party of the second part
his heirs executors or administrators or assigns the sum of
money mentioned Two Hundred and Fifty Dollars on the first day
of January AD 1885 with interest according to the true intent
and meaning thereof together with all costs charges and
expenses including attorneys fees and commissions which the
said party of the second part may incur or be put to in
collecting the same by foreclosure or otherwise and shall pay
all taxes and assessments levied or assessed on said mortgaged
premises and shall comply with all the covenants contained
in this mortgage and pay all the moneys secured that
then these presents and the estate hereby granted shall cease
determine and be absolutely null and void And the said
parties of the first part for themselves and their heirs executors
and administrators do hereby promise covenant and agree to pay
to the said party of the second part his executors administrators
or assigns the said sum of money and interest as mentioned in said
note and secured to be paid as aforesaid and if default shall be
made in the payment of said Sum of money or any part thereof
