On or before the first day of Oct^1882 we promise to
pay N.J. Jones & Co or bearer the Sum of Fifty Eight 82
Dollars with fifteen per cent interest after the 1st day
Oct AD 1882 for value received, we do hereby waive all
benefits of Homestead and exemption Laws now in
force on the Sum of money mentioned in Said promisory

Now this Indenture witnesseth that the said partys of the
first part for the better securing of the payment of the
said Sum of money mentioned in said note and
also for and in Consideration of the Sum of one Dollar
to them in hand paid by the said partys of the second
part at or before the ensealing and delivery of these
presents the receipt whereof is hereby acknowledged
have granted bargained sold aliened remised re-
leased Conveyed and Confirmed and by these pres-
ents do grant bargain sell alien remise release
Convey and Confirm unto the said partys of the Second
part and to their heirs and assigns forever All that Cer-
tain tract or parcel of Land lying and being in Alach-
ua County State of Fla to wit: South East Quarter of
North West Quarter Section Four (4) Township Seven
(7) South Range Nineteen (19) East. Together with all
and Singular the tenements hereditaments and appur-
tenances thereunto belonging or in anywise appertaining
and the reversion and reversions remainder and remain-
ders rents issues and profits thereof. And also all the
estate right title interest dower and right of dower
separate estate property possession Claim and demand
whatsoever as well in law as in equity of the said partys
of the first part of in and to the Same and every
part and parcel thereof with the appurtenances: To
have and to hold the above granted and described
premises unto the said partys of the second part
their heirs and assigns to them and their own proper
use benefit and behoof forever. Provided always and
these presents are on this express Condition that if the
said Joseph W. Malphurs and Mary Malphurs their
heirs executors or administrators shall well and
truly pay unto the said partys of the second part
their heirs executors or administrators or assigns the
said sum of money as Set forth in foregoing promisory
note according to the true intent and meaning of the
Same together with all costs charges and expense
of attorneys fees which the said partys of the second
