certain promissory note bearing date herewith and due and
payable one year from the date hereof with interest at the rate of ten
per cent a year payable annually and whereas she is desirous of
fully and better securing the payment of said note and sum of money
mentioned therein Therefore know all men by these presents that said
Mary J. Zinn in her own right and John W. Zinn her husband for and
in consideration of the premises and of one dollar to them in hand
paid have granted bargained sold and conveyed and by these
presents do grant bargain sell and convey unto the said John W.
Shearhouse his heirs and assigns all the following described piece
parcel or tract of land situated lying and being in the County of
Alachua and State of Florida to wit: Beginning at the North East
corner of the South West Quarter of the South West Quarter of Section
(26) Twenty six Township (10) Ten South Range (22) Twenty Two East
thence East (3) Three 69/100 chains thence South 5º10' - East Six 42/100
chains thence East 69/100 chains: thence South 5º10' East
Two (2.26) and twenty Six one hundredths chains thence North
85º45' East Four 16/100 chains thence along Rail Road ditch South West
four 86/100 chains thence South 85º45' West Ten and 50/100 chains
thence North thirteen and 70/100 chains back to place of beginning
Saving and excepting from the above described tract one acre in
the North West corner thereof and also the Ginning machinery on
said first mentioned tract Together with all and singular the
tenements hereditaments and appurtenances to the same belonging
or in any wise appertaining To have and to hold the same unto
the said John W. Shearhouse his heirs and assigns forever Provided
however and these presents are upon this express condition that if the
said Mary J. Zinn her heirs or assigns shall well and truly pay or
cause to be paid the sum of money covenanted to be paid by said
note together with the interest to accrue thereon according to
the legal tenor and effect thereof then this obligation shall
become null and void otherwise to remain in full force and
virtue and it is hereby further agreed and Stipulated that
the said Mary J. Zinn her heirs or assigns will pay all costs
expenses and attorneys fees which the said John W. Shearhouse
may be put to in enforcing the collection of the aforesaid
sum of money covenanted to be paid by said note by foreclosure
or otherwise In Witness Whereof we have hereunto set our hands
and affixed our seals this Fifteenth day of January AD 1884
